Terms and Conditions

 Outside the Box Home Designs Terms and Conditions

By engaging in our services you agree to the following terms and conditions:

1. Services Provided

Outside the Box Home Designs Ltd offers services, including but not limited to:

· Feasibility Study

· Site Survey

· Conceptual and Planning Design

· Planning Applications

The scope of services to be provided will be specified in the agreement or proposal between us and the client.

2. Project Scope and Deliverables

The specific deliverables for each project will be outlined in a signed agreement or proposal. Any changes or additions to the agreed scope of work after project commencement must be mutually agreed upon in writing and may incur additional charges.

Unless we receive a written response to the contrary within seven (7) working days of the fee proposal letter, we will assume that the contents accurately and completely reflect the agreed scope of works.

If you require services beyond those specified in the fee proposal, we reserve the right to adjust the agreed fee accordingly. An estimate or quotation for any additional services will be provided upon request.

A typical residential project (e.g. a 3–4 bedroom house) includes:

· A site survey (approx. 2–4 hours)

· Two (2) rounds of client comments on the initial draft drawings

· One (1) face-to-face or video meeting

· Preparation and submission of the planning application
(Note: The Planning Portal application fee is payable directly by the Client)

· Two (2) rounds of revisions in response to feedback from the Local Planning Authority

3. Fees and Payment Terms

Fees for our services will be agreed upon before commencing the work and will be outlined in a formal agreement. Payments can be made depending on the project terms.

· Full payment for each item is required upon:

o Completion of the Site Survey 

o Completion of the Planning drawings up to the point at which drawings can either be tendered with Builders or submitted to Planning

o Completion of the Planning Application 

Failure to make timely payments may result in suspension of services until the outstanding balance is paid in full.

All our invoices are due for payment at 28 days after the date of the invoice. We reserve the right to exercise our statutory right to charge interest under the Late Payment of Commercial Debts (Interest) Act 1998 if we are not paid according to our terms. The interest rate to be charged on outstanding debts will be charged at the rate of 4% over the Bank base rate for the period over which our money is owed.

4. Expenses 

Ordinary out-of-pocket expenses incurred in the course of providing the agreed services — including, but not limited to, travel costs, online planning documents, and related charges — will be reimbursable in addition to our professional fees, unless stated otherwise in writing.

We will always seek your prior approval before incurring any disbursements or expenses that are considered excessive or fall outside the scope of normal, routine expenditure.

5. Client Responsibilities

  • Provide Information: Clients must provide accurate      information, including site details, budget constraints, and any other      necessary documents or approvals required for the project. 
  • Timelines: The Client will ensure that we      are provided in good time with all information needed including an agreed      design programme to enable us to perform the Services agreed. We shall use      all reasonable endeavours to adhere to design programmes agreed with you for      the provision of our services, but will not be responsible for any delay      which is due to reasons attributable to you or otherwise beyond our      control. Any delays caused by the client’s failure to meet deadlines or      provide necessary approvals may result in adjustments to the project      timeline and additional fees.
  • Approvals: The client is responsible for      obtaining all necessary permits, approvals, and consents from local      authorities and relevant parties before work begins. Whilst we actively      aim to ensure Planning approvals/permission is obtained for Projects and      work with Clients and Local Authorities to ensure this can happen, this is      not a guarantee, and applications can be subject to refusal.
  • Timely Feedback: Clients agree to provide timely      feedback and make decisions as necessary throughout the project to avoid      delays.
  • Complaints: Any complaint or dispute      about either the works provided or any of our invoices should be notified      to us either immediately (for the works) or within 15 days of the invoice      date (for invoices). After the 15 day period, we shall assume that our      invoice has been accepted for the services carried out.

6. Intellectual Property

  • Ownership of Deliverables: All drawings, designs, models,      and other creative works created during the course of the project remain      the intellectual property of Outside the Box Home Designs Ltd unless      otherwise agreed upon in writing.

· Copyright: Subject to the Client paying all fees and expenses which are due, the Client will have a licence to copy and use documents issued and owned by Outside the Box Home Designs for any purpose relating to their project for which our services are provided, but not for any other purpose.

· Social Media: We reserve the right to post the drawings on our Social Media and Business platforms. All identifying features will be removed. 

7. Facilities and Access

The Client shall arrange for or grant Outside the Box Home Designs safe access at all reasonable times to such premises as may be necessary for the provision of Outside the Box Home Designs’ Services.

8. Confidentiality

Both parties agree to maintain confidentiality regarding any proprietary or confidential information shared during the project. This includes, but is not limited to, design concepts, business processes, and financial information.

9. Agreement

Either party may terminate the agreement with written notice within 14 days of the breach of Agreement under the following conditions:

  • Termination: Either party may terminate this      agreement upon providing 14 days written notice to the other party. In the      event of termination, the Client shall compensate Outside the Box Home      Designs for all services performed up to the effective date of      termination, including reimbursable expenses incurred. If Outside the Box      Home Designs terminates the agreement due to a breach by the Client, Outside      the Box Home Designs shall be entitled to full payment for work completed      and for any documented work-in-progress.
  • Outstanding Payments: All unpaid fees and      reimbursable expenses accrued up to the termination date shall become      immediately due and payable. In the event of late payment, the Architect      reserves the right to charge interest at a rate of 4% per month (or the      maximum rate permitted by law, if lower), calculated from the due date      until payment is received in full.

10. Liability

Limitation of Liability: Outside the Box Home Designs Ltd will not be liable for any indirect, incidental, or consequential damages resulting from the services provided. Our liability is limited to the amount of fees paid by the client for the specific services related to the claim.

Insurance: We maintain Public Liability, Employers’ Liability and Professional Indemnity insurance for the duration of the project.

You shall indemnify Outside the Box Home Designs against any claim howsoever arising as a result of the works. This includes any damages incurred in relation to the services provided.

11. Communication

We shall communicate with you by post, verbally and email. We shall take all reasonable precautions to ensure that emails or other electronic data will be free from viruses. We do not, however, to the extent permitted by law, accept any liability (whether in contract, negligence or otherwise) for virus corruption of data issued.
